International Arbitration: Is International Arbitration Stagnating? Would Asian Arbitration Centers Pour Fresh Blood in International Dispute Resolution Procedure?

The focus of the round table will be on features of Asian dispute resolution centers, such as SIAC, CIETAC and HKIAC that make them attractive as a seat of international arbitration, including with participation of Russian companies. The speakers will make a link between those features and current efforts to reform commercial arbitration legislation and create an international arbitration center in the Russian Federation. As relevant to “pocket” arbitration courts in Russia and proposals to introduce obligatory certification of arbitral institutions, including international arbitral institutions, in the Russian Federation, experience of some jurisdictions with such certification will be analysed.
An analysis of activities of world arbitration centers shows that competition among them can only be expected to intensify in years to come. If an international arbitration center in the Russian Federation is to be created, to survive in such heavy competition, it has to draw on lessons learned from the experience of world-renowned commercial dispute resolution centers with handling arbitration and mediation/conciliation cases. It should also be in a position to show an added value of referring disputes to the Russian international arbitration center as opposed to existing ones with the already established good reputation. What would the Russian international arbitration center be ready to offer?
In the course of the round-table discussion, representatives of leading Asia international arbitration centers will share their experience with other discussion participants. Representatives of government officials, leading experts in arbitration, major business associations and practicing lawyers will discuss ideas for reforming the commercial arbitration system in Russia.
